Non-HIPAA Compliance

 

Global Guard Inc. does NOT use a HIPAA-compliant website, and the information shared through our platform does not receive the same level of protection as required for Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA) because we DO NOT handle PHI on behalf of covered entities such as healthcare providers or health plans and the information stored is de-identified. By using our services, you acknowledge that any personal or medical information you provide is shared voluntarily, and you assume the associated risks. We strongly encourage users to carefully consider what information they disclose, as the platform does not offer HIPAA-level privacy and security protections.

 

 

Individual Responsibility and Consent

 

  • Voluntary Information Submission: You may choose to submit personal and medical information to create customized cards. This information may include details about allergies, medical conditions, or emergency contacts. By providing this information, you confirm that you do so voluntarily and with full awareness of the privacy risks. Global Guard Inc. takes reasonable steps to protect your data but cannot guarantee the same protections as a HIPAA-compliant service.

  • Informed Consent: By using our services and providing personal or medical information, you acknowledge and agree to the following:

    You understand that our platform is not HIPAA compliant and does not follow HIPAA standards for protecting medical information.

    You acknowledge that while we implement security measures to protect your information, we cannot offer the same level of protection as a HIPAA-compliant entity.

    You agree that the information you provide is submitted voluntarily and with full awareness of the associated risks.

  • Separate Acknowledgment: At the time of checkout or registration, you will be required to explicitly acknowledge your understanding and acceptance of the non-HIPAA compliant status of our platform. This acknowledgment will be captured through a consent checkbox, separate from the general acceptance of our terms and conditions.

 

Data Security Measures: While we implement industry-standard security measures such as encryption and secure payment gateways, users should be aware that our platform’s security is not equivalent to that of a HIPAA-compliant service. We cannot guarantee the complete confidentiality and protection of sensitive medical information. Users are encouraged to limit the amount of sensitive data shared and utilize additional personal precautions for safeguarding their privacy.

Changes to This Policy

We may update this privacy policy to reflect changes in our practices, legal requirements, or other factors. If Global Guard Inc. transitions to a HIPAA-compliant platform in the future, we may collaborate with healthcare providers, health plans, or other covered entities to handle Protected Health Information (PHI). In the event of such changes:

  • Future Collaboration and HIPAA Compliance: Should we begin handling PHI on behalf of covered entities, we will fully comply with HIPAA standards and regulations to ensure the privacy and security of medical information.

  • De-identification of Information: Any personal or medical information provided before such a transition will be de-identified according to HIPAA's de- identification standards. De-identified information is no longer considered PHI under HIPAA, and no additional consent will be required for its use.

  • New Consent for Identifiable Information: If Global Guard Inc. intends to use or share identifiable PHI, we will obtain explicit consent from individuals prior to doing so.

  • Information Protections and Consent: We will continue to prioritize the security and confidentiality of the information provided. Any updates involving the handling of PHI or collaborations with covered entities will be clearly communicated, and new consent will be obtained where applicable.

 

Individuals will be notified of any significant changes to this policy. Continued use of our services after any policy updates will indicate acceptance of the revised terms.
